At what point does the compliance burden of a South African trust outweigh its benefits?
📜 The proposed Regulation of Trusts Bill, 2026 may be the most significant overhaul of South African trust legislation in almost 40 years.
The message from lawmakers appears clear:
➡️ More reporting
➡️ More disclosure
➡️ More oversight
➡️ More personal liability for trustees
➡️ More involvement from the Master of the High Court
Under the proposed legislation, trustees could face:
• Annual returns and annual fees
• Extensive beneficial ownership reporting
• Administrative penalties and fines
• Greater scrutiny of trust affairs
• Criminal sanctions for serious non-compliance
⚖️ Trusts are not disappearing.
But the days of the “set it up and forget about it” family trust may be coming to an end.
🌍 What is particularly interesting is that many South Africans still view offshore trusts as complicated, heavily regulated structures, while assuming local trusts are relatively straightforward.
That distinction may be narrowing rapidly.
In reality, many international trust jurisdictions have spent decades refining professional trust administration, governance standards and succession planning frameworks.
As South Africa moves towards a far more regulated trust environment, I believe more families will begin asking:
❓ If I am going to operate in a highly regulated trust environment anyway, should I be considering a structure specifically designed for international wealth, cross-border assets and multi-generational succession planning?
For internationally mobile families, business owners with offshore investments, or those looking at long-term wealth preservation, this is becoming an increasingly relevant discussion.

It may be a question of which jurisdiction offers the most appropriate governance, continuity, flexibility and long-term certainty for your family’s circumstances.
